Welcome to Rally. These Terms of Service ("Terms") are a legal agreement between you and Rally ("Rally," "we," "us") governing your use of the Rally website, app, and related services (the "Service"). By using Rally, you agree to these Terms. If you don't agree, please don't use the Service.
Rally is operated by [legal entity / operator name]. Contact: hello@tryrallynow.com.
You must be at least 13 years old to use Rally. Some activities listed have their own age requirements set by the venue or organizer (for example, 21+ where alcohol is served); you're responsible for meeting them.
You're responsible for the activity on your account and for keeping your sign-in secure. Provide accurate information and let us know promptly if you suspect unauthorized use. You may sign in with email or with Google.
Rally helps you discover things to do in NYC and plan them with friends. Listings — dates, prices, times, locations, links — are gathered from public and third-party sources and provided for your convenience. We don't run these events and can't guarantee that details are accurate, current, or available. Always confirm with the venue or organizer before you go or pay. Rally is not responsible for third-party events, venues, ticketing, or their content.
You keep ownership of the content you create on Rally (messages, photos, plans, polls, and similar). By posting it, you grant Rally a non-exclusive, worldwide, royalty-free license to host, store, display, and share it as needed to operate the Service (for example, showing your message to others in your chat, or your liked items to your friends). This license ends when you delete the content or your account, except for copies retained as required by law or already shared with others.
You're responsible for your content and must have the rights to post it.
Don't use Rally to: break the law; harass, threaten, or harm others; post content that is illegal, hateful, abusive, or sexually exploitative (especially involving minors); spam or impersonate others; infringe anyone's intellectual property; or interfere with, scrape, or attempt to disrupt the Service. We may remove content or suspend accounts that violate these Terms.
Rally includes social features — connecting with friends, creating and joining plans, and group/direct messaging. Be respectful. Content you share is visible to the people in the relevant plan or chat. We are not responsible for the conduct of other users, online or in person; use your judgment when meeting people or attending events.
Rally's bill-splitting feature helps a group divide a check and shows each person's share. Rally does not process, hold, or transfer money. Payments happen through third-party apps you choose (such as Venmo) under their own terms. Rally is not a party to those payments and is not responsible for amounts, disputes, or whether anyone actually pays. Receipt amounts and splits are estimates based on what's entered or scanned — confirm them yourself.
The Service links to and integrates with third parties (event pages, venues, ticketing, mapping, payment apps). Links are not endorsements, and we don't control or take responsibility for third-party sites or services. Your use of them is governed by their terms.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or that listings are accurate or complete.
To the fullest extent permitted by law, Rally and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the Service, third-party events or services, or other users' conduct. Our total liability for any claim relating to the Service will not exceed USD $100.
You agree to indemnify and hold harmless Rally and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or others' rights.
You can stop using Rally and delete your account at any time. We may suspend or terminate access if you violate these Terms or to protect the Service or its users.
We may update the Service and these Terms from time to time. We'll post the updated Terms here with a new date; for material changes we'll provide additional notice where appropriate. Continuing to use Rally after changes means you accept them.
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules. Disputes will be handled in the state or federal courts located in New York, New York.
